How your purchase and use of From Here are governed.
Agreement
By checking the box indicating your agreement to these Terms of Use, you enter into a binding agreement with From Here (“From Here,” “we,” “us,” or “our”). These Terms govern your purchase and use of the From Here career clarity assessment and personalized report (the “Service”).
By agreeing to these Terms, you also acknowledge that you have read and understood the From Here Disclaimer and Privacy Policy, which are incorporated into these Terms by reference.
If you do not agree to these Terms, do not purchase or use the Service.
Eligibility
You must be at least 18 years of age to use the Service. By agreeing to these Terms, you confirm that you are 18 or older.
What the Service is
From Here provides an educational career clarity assessment that generates a personalized report based on your responses. The Service is designed to support personal reflection and decision-making during career transitions.
The assessment and report are educational and informational in nature. They are not professional advice of any kind.
What the Service is not
The Service is not occupational therapy, counselling, psychotherapy, psychological assessment, career counselling, financial advice, or any other regulated professional service. It does not provide clinical, therapeutic, or diagnostic services.
No professional-client relationship of any kind is formed between you and From Here, its creator, or any party involved in delivering the Service. Your use of the Service does not create a duty of care.
AI-generated content
Your personalized report is generated using artificial intelligence based on the assessment frameworks designed by the creator. While the AI produces the report content, the creator reviews each report before delivery as part of From Here's quality assurance process. This review is operational and editorial in nature. It is not professional advice, clinical assessment, or any form of regulated health service.
By agreeing to these Terms, you acknowledge and accept that:
• The report is generated by AI and may contain inaccuracies, incomplete information, or content that does not fully reflect your specific circumstances.
• Factual assertions in the report should not be relied upon without independently verifying their accuracy.
• The report reflects a single point in time and does not account for changes in your circumstances after the assessment is completed.
• The report is one input into your decision-making, not a directive. You are solely responsible for any decisions you make based on its content.
Professional advice
The Service is not a substitute for professional advice. If you are experiencing a mental health difficulty, workplace crisis, or other situation requiring professional support, please consult a qualified professional.
If you are considering a significant career or financial decision, you are encouraged to seek advice from a qualified career counsellor, financial advisor, or other relevant professional before acting.
Payment and delivery
The Service is provided as a one-time purchase at the price displayed on the website at the time of your purchase. All prices are listed in Canadian dollars (CAD). If you are purchasing from outside Canada, your payment provider will convert the charge to your local currency at the prevailing rate. By proceeding with payment, you authorize the charge to your selected payment method.
Once you submit your assessment responses, your personalized report is generated and delivered electronically to the email address you provided, within two business days of submission.
Refund policy
If the Service fails to deliver a report due to a technical issue (for example, the assessment does not process or the report does not generate), you are entitled to a full refund or a replacement report, at your choice.
Because the report is a personalized digital product generated from your specific responses, refunds are not available on the basis that the report’s content did not meet your expectations. The educational and AI-generated nature of the report is disclosed in these Terms before purchase.
If you believe there is a reason for a refund not covered above, please contact us at hello@fromhereco.ca. We will consider requests on a case-by-case basis.
Third-party services
The Service relies on third-party technology providers to function, including form collection, automation, and AI processing services. These providers are identified in the Privacy Policy.
From Here does not control these third-party services and is not responsible for their availability, performance, or any interruptions caused by their systems. If a third-party service outage prevents delivery of your report, From Here will provide a replacement report or a full refund once the issue is resolved.
Intellectual property
The assessment framework, classification system, report templates, and all associated materials are the intellectual property of From Here. Your personalized report is provided for your personal use only. You may not reproduce, redistribute, publish, or use the report for commercial purposes without written permission from From Here.
Limitation of liability
The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the fullest extent permitted by applicable law, From Here, its creator, and its service providers accept no liability for any indirect, incidental, consequential, or special damages arising from or related to your use of the Service, including any decisions made, actions taken, or outcomes experienced as a result of reading your report.
Your responsibilities
You agree not to:
• Represent the report as professional advice, a clinical assessment, or a regulated service when sharing or discussing it with others.
• Reproduce, redistribute, or commercially exploit the report or any part of the Service.
The report is not designed or intended for use as evidence or documentation in any legal, employment, insurance, or regulatory proceeding, and From Here makes no representation as to its suitability for such purposes.
You agree to indemnify and hold harmless From Here and its creator from any claims, damages, or expenses arising from your breach of these Terms or your misuse of the Service or the report.
Governing law and jurisdiction
These Terms are governed by and interpreted in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any dispute arising out of or in connection with these Terms or the Service shall be brought exclusively in the courts of the Province of British Columbia, and you consent to the exclusive jurisdiction of those courts.
Privacy and data
Your assessment responses and personal information are handled in accordance with the From Here Privacy Policy, which is incorporated into these Terms by reference.
By using the Service, you consent to the collection, use, and processing of your information as described in the Privacy Policy. This includes the transfer of data to third-party service providers for the purpose of delivering the Service. These providers are located in the United States and Switzerland, as described in the Privacy Policy.
Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will post the updated Terms on our website with a revised “Last updated” date. Changes will not apply retroactively to purchases made before the changes were posted. Any new purchase requires acceptance of the then-current Terms.
If you contact us with a question or concern about a purchase, the version of these Terms that was in effect at the time of your purchase will apply.
Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
Entire agreement
These Terms, together with the Disclaimer and Privacy Policy, constitute the entire agreement between you and From Here regarding the Service, and supersede any prior agreements or communications.
